With regard to your subsequent questions, we can advise that Lancashire County Council does not hold information about the number of teachers to which the incidents refer (as the notifications are made anonymous), or details of action taken, as this is not recorded by the County Council.
 
Although Lancashire County Council does hold summaries of the incidents, and the districts and schools in which they occurred, collating this information would require manual analysis of each incident report.  Given the number of reports per year, this would incur a commitment of resources in excess of the limit of £450 set by the Freedom of Information and Data Protection (Appropriate Limit and Fees) Regulations 2004 (SI No. 3244 of 2004), which equates to 18 hours of work. Section 12(1) of the Freedom of Information Act provides that a public authority is not obliged to comply with a request where to do so would exceed such a limit.

1. For each academic year* in the period 2002/03 to the last complete year, please let me have the total number of incidents reported to you by all schools which relate to racist incidents, homophobic incidents and all other hate-related bullying incidents. 
 
If held, please also:
 
(a) show figures for nursery, primary and secondary levels (and/or by age group).
(b) provide a breakdown of these figures according to nature of incident (i.e. verbal name-calling/ physical violence/threat of violence/graffiti etc).
(c) provide a breakdown of these figures according to the status of victims and perpetrators (i.e. incidents against pupils or against staff).
(d) provide a breakdown of these figures according to gender, ethnicity (or any other category you use) of victims and perpetrators.
(e) indicate any individual cases which have required Police involvement.

(g) include any written discussion or action-points that officers have produced in response to incident data or individual cases (i.e. notes on observable trends and any appropriate action the LEA intends).

(i) provide numbers/percentages of schools who have returned incident reports and numbers/percentages of schools in which incidents have taken place.
 
2. Please provide me with a copy of the definitions and guidance you are currently supplying to schools on racist, homophobic and all hate-related bullying incidents. If held, please also provide me with copies of previous versions of the guidance
 
Please note:    (i) I am only requesting the information you hold according to the standard practices you operate (i.e the documentation as it currently exists). I therefore do not expect you to provide me with any of the detailed information listed above unless it is already collated, has been retained and is on-file.

These figures are for 2008-09, which is the most recent year for which information is available
 
I would like to ask how many school days were missed in your area by pupils who were away on holiday with their families. Please provide information for the most recent year for which information is available.
 
We record attendance as sessions, which are half days, so the figures provided are in sessions, which are then halved to get the equivalent number of days
Primary – sessions of absences for authorised holidays and extended leave = 196850 which when halved equates to 98425 days missed
Primary – sessions of absence for unauthorised holidays = 11911 which when halved equates to 5955.5 days missed
 
Secondary – sessions of absence for authorised holidays and extended leave = 94292 which when halved equates to 47146 days missed
Secondary – sessions of absence for unauthorised holidays = 14252 which when halved equates to 7126 days missed
 
As a percentage of total possible sessions this is
 
Primary absences – authorised holiday and extended leave = 0.86% of total possible sessions of attendance in Lancashire

We issued 21 Penalty Notices to parents (in respect of 19 children) where children were taken out on holiday without permission from school
Of these, 11 were paid, and 10 were not paid so court prosecutions followed for these 10 cases.

To address your second point, in which you ask for a breakdown of teaching staff within Balshaw's CE High School, we can confirm that Lancashire County Council does hold this information, however, it is absolutely exempt from disclosure under section 40(2) of the Freedom of Information Act, by virtue of section 40(3)(a)(i). The requested information is the personal data of the individuals concerned, and disclosure of this information is likely to lead to the identification of the individuals and their ethnicity. Ethnicity is an especially significant area of Data Protection, as it is considered 'sensitive personal data' and is subject to tighter restrictions with regards to processing, including disclosure. Consequently, disclosure would be unfair, and thus a breach of the first data protection principle.

Total stock holdings are: 489,915 items with the majority of this stock in schools at any one time.  Each short term loan box contains a minimum of 30 items.

26 Nurseries , Former Grant Maintained and short stay schools have had funding fully delegated. 528  schools have funding devolved and earmarked for School Library Services.

Attached is the list of 'controlled' crossings that also have a school crossing patrol, there are 45 in all.

Cost of a school crossing patrol per point per annum = £4,203. Total cost for patrols on the 45 alternative points = £189,135 / annum. which is 12.5% of the total budget.

By school, I mean secondary, primary, nursery and special schools in the LEA.However, you only need include in the list those schools where there have been expulsions.There is no need to include in the list schools which have seen no expulsions during that school year.

1.     For each school in the LEA, the number of pupils aged 16 and under expelled in the 2008/9 school year
 
The total figure for permanent exclusions in Lancashire in 2008/2009 was 256.
 
Although Lancashire County Council does hold details of the schools from which pupils were excluded in 2008/09, this information is absolutely exempt from disclosure under section 40(2) by virtue of section 40(3)(a)(i).  This is because, given the small numbers concerned at each school, and the other details disclosed, it would be possible to identify individuals.  Disclosure of this information into the public domain would be unfair, and thus a breach of the first data protection principle, as set out at schedule 1 to the Data Protection Act 1998.
 
2.    The age, or school year, of each of the expelled pupils

Exclusions under the DA (drugs/alcohol) category in primary schools are extremely rare. Exclusion rates under the DA category in secondary schools are also very low, at less than 1 incident per school in 2009/10, and there has been a downward trend since 2005/6.

We should point out that although the child measurement programme takes place in schools, the work is undertaken by Primary Care Trust (PCT) staff and the information is published by the NHS Information Centre.  We are able provide data on this occasion because our Joint Strategic Needs Assessment Team (JSNA), working with NHS colleagues, have been undertaking a detailed analysis of the data.  Ordinarily, Lancashire County Council might only expect to receive headline figures (i.e. proportions of overweight and obese children across the county and in each district).
 
As you will notice from the table above, we are unable to provide data for 2009/10 at this time as we have not yet received it yet from the NHS Information Centre. Under section 1.7 of the PSHE education criteria for the Healthy Schools award, schools are expected to involve:

The Lancashire Healthy Schools Programme shares the guidance produced by a neighbouring Unitary programme which places the responsibility on the school to be its own gatekeeper, to have clear procedures and protocols including mutual evaluation to measure the added value the agency contributes to the taught curriculum.
 
The Lancashire Healthy Schools Programme does not recommend particular external agencies. Our website contains a database of good practice case studies written by members of the school workforce which offers the opportunity for schools to identify agencies they have used on a wide range of issues.

Schools are autonomous organisations and the responsibility of what is considered appropriate lies with the school in accordance with the school policy. The focus is more on the teaching of a broad and balanced curriculum designed to meet the needs of the young people.

It is statute that all schools have a Sex Education Policy. The school decides what is written in that policy. As long as they have an up to date policy they are eligible for Healthy School Status.

It might include the use of services to work with a family where there are alcohol and or drug issues or School Health workers.

They are not; they refer pupils to the specialist services addressing the needs of the pupils which are usually in connection with family support and/or mental health.

Can you please provide me with your authority’s pupil admissions policy for voluntary controlled schools with a religious character under its jurisdiction, and where the pupil admissions policies between separate voluntary controlled schools with a religious character differs, can you please supply me with the different policies for these schools.

Lancashire has 478 primary schools and 83 secondary schools. Of these 51 primary schools and 1 secondary school are voluntary controlled schools with religious character.
 
I can confirm that the admission arrangements for voluntary controlled schools with a religious character are the same as schools without a religious character.
