The number and percentage of registered disabled employees
 
The "registered" disabled person system was abolished by the Disability Discrimination Act in 1995, effectively from 2 December 1996. Lancashire County Council’s figures now relate to the number of employees who choose to disclose that they "consider themselves to be a disabled person or a Deaf person". As of November 2009 there are:
 
678 disabled employees (1.72% of the workforce) within the LCC workforce including those employed in schools.
473 disabled employees (2.98% of the workforce) within the LCC workforce excluding schools.
 
These are the figures for people who have chosen to disclose a disability to our HR recording system. It is probable that this is significantly less than the actual number of employees who are covered by the DDA definition of disability.
 
The number and percentage of registered disabled volunteers
 
Lancashire County Council (LCC) does not have a central record of the number of disabled volunteers working with the Council.  We are currently working on creating a "volunteers hub" to centralise volunteering arrangements. The work is at a fairly early stage and we are trying to establish some consistency in volunteer arrangements. With this said, unfortunately, we can not collate the information for this part of your request, as we would have to go to each of the different departments within LCC to gather this information. This would incur a commitment of resources in excess of the limit of £450 set by the Freedom of Information and Data Protection (Appropriate Limit and Fees) Regulations 2004 (SI No. 3244 of 2004), which equates to 18 hours of work. Section 12(1) of the Freedom of Information Act provides that a public authority is not obliged to comply with a request where to do so would exceed such a limit.

Lancashire County Council has approximately 44000 employees on its payroll.

We can confirm that there are no services outsourced to any private/public sector providers.

Under the Freedom of Information Act 2000 please disclose the job title of each and every taxpayer funded employee at Lancashire County Council who earns £48,000 or more per annum. I choose this figure because it is exactly twice the nominal average wage in this country and it is these people that fund salaries at Lancashire County Council.
    
If any Councillors "earn" £48,000 or more per annum can they also be added?

In 2009/10 we made pension payments from the pension fund totalling £141,346,940.88. Based on the number of pensioners at the end  of that financial year the average would be £3933.62 pa.
 
4.     If the scheme administration is performed in-house

To administer the Local Government Pension Scheme cost £2831k in 2009/10.
 
5.     What is the total spend to date with your current administration software provider since the start of your contract
Section 1(1) of the Act provides that a public authority has a duty to state in writing whether it holds information of the description specified in a request; and in accordance with our obligations I am able to confirm that Lancashire County Council does hold the information you have asked for in respect of the above.
 
However, section 43(2) of the Act permits information to be withheld, subject to the application of a public interest test, where disclosure would, or would be likely to, prejudice the commercial interests of any person.
I have now had the opportunity to consider the exemption under Section 43 as it applies to the information you have requested; and in particular whether the public interest lies in favour of maintaining the exemption or in disclosing this information to you.
 
In considering the public interest test, I acknowledge that, as a general principle, there is a public interest in public authorities being as open and transparent as possible and disclosure would improve the accountability and transparency of the Authority. However, there is also a considerable public interest in safeguarding the ability of organisations to benefit from the competitive advantage gained through developing best practice in their chosen field of business. Similarly, there is also a strong public interest in public authorities being able to obtain best value for money when negotiating with suppliers and contractors, and thus ensuring that limited public funds are used as economically as possible.  In balancing the public interest, I have concluded that these factors outweigh any benefit that would be gained by disclosure of the information to which the exemption applies.
 
In light of the above, it is my view that in all the circumstances of this case, the public interest in disclosure is outweighed by the public interest in maintaining the exemption in respect of the information relating to the spend with our current administrations software provider; and this aspect of your request is therefore refused.

Further to your email of 17th September 2010, we are now in a position to respond to your enquiry regarding 'Climate Change Staff'. We have answered each point of your enquiry below.
 
·         We have no members of staff with the words climate, carbon, sustainability, global, warming, low carbon, etc in their job title.
 
·         We have environment project officers that have generic job descriptions.  Some of these officers will take on the ‘climate’ related duties presented by central government to local government (eg statutory carbon reduction commitment, national indicators, working with district council colleagues to provide insulation and tackle fuel poverty in domestic properties).  Other project officers do not take on these climate related tasks.
 
·         There are approximately three environmental project officers that undertake these sort of climate related duties as part of a much wider role which includes non-climate work.  The job description is attached, and it can be seen from the JD that climate related activity is one part of a much wider role, which centres on developing community and environment projects.  The posts were created as part of a department restructure earlier this year. The salary banding for these project posts is grade 8 (£26,276 – £30,011).  There are no car allowances associated with these posts.

Further to your email dated 19th October 2010 in which you request the disclosure of information under the provisions of the above Act, we are now in a position to provide you with a response.

Response from the Directorate for Children and Young People

  1. Yes, the County Council has carried out a health check exercise with teams of social workers in both Adults and Children & Young People’s Directorates based on the suggested template set out in annexe A of the SWTF report – ‘Building a Safe & Confident Future.
  2. The health check was initially carried out between March and April, but following the publication of the timetable for action in the Implementation Plan a much wider exercise was carried out between May – August to cover all teams that have qualified social workers based in them.
  3. A template health check table based on the Enablers & Outcomes set out in Annexe A was prepared and sent to all managers for teams to complete. This included effective workload management, proactive workflow management, having the right tools to do the job as enablers, and a healthy workplace and effective service delivery as the outcomes. The health checks were carried out within the normal process of team meetings.
  4.  Yes, the Directorates have and are introducing a range of new and amended policies and procedures and have had a joint directorate ‘task and finish’ group established early in 2010 to oversee changes to and the introduction of them.

Response from the Directorate for Adult and Community Services

  1. Yes we have undertaken a health check assessment of all social work teams across Adult and Children's services.  The health check included looking at all areas as detailed in the SWTF Report Annexe attached. 
  2. We undertook this by developing an assessment template using all of the headings in this document which all teams completed as a team exercise during May/July 2010.
  3. The teams responses were compiled into Directorate level assessments, one for Children's services and one for Adults' services, along with Directorate action plans to address the issues raised in the health checks. The response to each question was assigned a rating: Red = Criteria not met;  Amber= issue identified and action being taken; and Green = Action completed, standard/criteria met.   We have then  compared the responses across the Directorates to identify joint areas for action or areas where we could share learning, and are currently in the process of combining the Children's and Adult's  assessments into a joint assessment, with actions attached as to how we are going to address any areas identified as amber or red.   This plan will be agreed by the Executive Directors of Adults and Children's services before being submitted to the Social Work Reform Board by January 2011.
  4. We will monitor progress on the actions identified within the plan and will be going back to teams on a regular basis to reassess their positions as part of this monitoring process.

1.    Please provide the name and most recently published salary (i.e. 2009-10) of your chief executive
Ged Fitzgerald is the Chief Executive.  The Chief Executive's Salary for 2009/10 was £194,655.  Please note that Ged Fitzgerald came into post in June 2008, therefore attached figures in response to question 2 for the 07/08 year relate to the previous Chief Executive.
 
2.    Please provide me with a spreadsheet detailing for each of the financial years 2007-08, 2008-09 and 2009-10 how much your chief executive claimed for each of:

Further to your email, we are now in a position to respond to your enquiry regarding Lancashire County Council's pension scheme. However, we would firstly like to apologise for the length of time it has taken to deal with your request and hope this has not caused you any inconvenience. We have answered each point of your enquiry below.
 
a)     How many individuals eligible for membership of the Local Government Pension Scheme were employed by the authority?
b)     How many of those employees were active members of the Local Government Pension Scheme?
 
Regarding the above questions, we can confirm that we are unable to provide the information requested. Lancashire County Council only record the percentage of eligible and active members of the Scheme. The data used to calculate the percentage is not recorded and there we do not hold the information.
 
Please see below for the percentage of eligible LCC employees who were active members for the years requested as shown below. The % is taken as a snapshot in time.
